3. Purpose of the site
webricks.co presents the activity of Webricks and allows you to get in touch. Service descriptions and prices shown are indicative and do not constitute a contractual offer within the meaning of article 1114 of the French Civil Code. Only the accepted quote and the general terms of sale bind the parties.
4. Intellectual property of the site
The structure of webricks.co, its text, visual identity, graphic charter and source code are the exclusive property of Webricks. Any reproduction, representation, adaptation or extraction, in whole or in part, by any process and on any medium, is prohibited without prior written authorisation and constitutes infringement punishable under articles L335-2 et seq. of the French Intellectual Property Code.
5. Ownership of delivered websites
One-off payment plan. The exploitation rights to the delivered site are transferred to the client after full payment of the agreed price. Until payment is complete, Webricks remains the holder of all rights.
Subscription plan. The client has a personal, non-exclusive right to use the site for the duration of the subscription. This right does not transfer any economic rights and ends automatically when the subscription ends.
In both cases, third-party components, open-source libraries, typefaces and Webricks working methods remain governed by their respective licences and are not transferred.
6. Content supplied by the client
The client warrants that they hold all rights to the material they provide: text, photographs, logos, trademarks, videos, testimonials and data of any kind. They warrant that this material infringes no third-party rights and is not unlawful.
The client indemnifies Webricks against any claim, action or judgment arising from that content, including defence costs incurred. Webricks reserves the right to refuse or promptly remove any manifestly unlawful content.
7. Availability and liability
Webricks has an obligation of means and applies reasonable diligence to ensure the accessibility and security of the sites it hosts. No guarantee of continuous availability is given outside a separate written service-level agreement.
Webricks cannot be held liable for interruptions attributable to the internet network, the host, third-party services (payment, messaging, domain name), client intervention on their own site, or force majeure within the meaning of article 1218 of the French Civil Code.
Its liability is in any event limited to direct and foreseeable damage and may not exceed the amount actually paid by the client over the last twelve months. Indirect damage is excluded, in particular loss of business, turnover, customers, data or reputation.
8. Search engine optimisation
Webricks applies technical and editorial best practice in search engine optimisation. Ranking in search engines depends on third-party algorithms, competition and external factors over which Webricks has no control: no guarantee of result, position or traffic volume is given.
9. Hyperlinks
Links to third-party sites are provided for convenience. Webricks exercises no control over their content and disclaims all liability in that regard. Creating a link to webricks.co is free, provided it does not harm the image of Webricks or suggest a partnership.
10. Personal data
The processing of personal data is described in the privacy policy, accessible from the footer.
11. Right of withdrawal
Consumer clients, and professionals employing no more than five staff where the service falls outside their main field of activity (article L221-3 of the French Consumer Code), have fourteen days from the conclusion of the contract to withdraw, without reason or penalty.
Where performance is requested before that period expires, the client makes an express request to that effect. In the event of withdrawal, they then pay the amount corresponding to the service already provided, in proportion to the agreed price.
Withdrawal is exercised by any unambiguous statement sent to [email protected]. Any refund is made within fourteen days of receipt of the request.
12. Complaints and mediation
Any complaint should be sent to [email protected]. Webricks undertakes to respond within thirty days.
In accordance with article L612-1 of the French Consumer Code, a consumer client who has not obtained satisfaction may refer the matter free of charge to the consumer ombudsman covering Webricks:
